LLC is not Green Card!

Be careful with those who sell that opening a company in the United States is the automatic path to your Green Card. This is the biggest mistake of those who open an offshore expecting immigration. An LLC is an excellent business vehicle, but it is not a visa. Let's separate the reality from the immigration fantasy.

LLC is not a visa

Having an American CNPJ (company registration), your EIN, does not give you the right to live in the USA. Not even an ITIN (the equivalent of a CPF for foreigners) grants you that right. You can have dozens of companies in Delaware, Nevada, Florida, Wyoming and still be denied entry at immigration as a tourist. The company is a legal entity for business and asset protection; your immigration status is a matter of individual and federal immigration laws that are completely different.

L1 and EB-5: the big players' game

There are business visas, such as the L1, for executive transfer, or the EB-5, for investors. But the requirements are high. In L1, you need to prove that the company in Brazil and in the USA operate together. In EB-5, the investment exceeds 800,000 dollars and needs to generate jobs.

It's not just "opening the company", it's proving a heavy and real capital contribution: with effective economic substance.

The need for a Business Plan

For any company to serve as a basis for a visa, you need a robust business plan. The American government wants to know how your business will benefit their economy. If your offshore is just a passive holding to hold money or invest in stocks, it will hardly serve as an argument for you to live there.

Substance: the real office

Visa requires substance. If you want an investor or work visa in your own company, you need a physical office, locally hired employees (a minimum of 10 Americans is recommended, with salaries in accordance with local legislation) and operations that justify your presence in the country to manage all this.

A "PO Box" in Wyoming does not give you the right to live in Orlando. Be sure of that.
